Final Rule Mandates the Use of E-Verify by Federal Contractors

On Nov. 14, 2008, the Federal Acquisition Regulations were amended by the issuance of a final rule requiring all federal contractors to use E-Verify to check the employment eligibility of newly-hired employees of a federal contractor or subcontractor, as well as all employees assigned to work on certain federal contracts. Absent any intervening legal action, the new rule will apply to all federal contract solicitations and awards valued over $100,000 and made after February 20, 2009.
